Kenyan judiciary halts the deployment of soldiers to quell crises,saying Kenya is not at war

The High Court has issued orders in a Law Society of Kenya (LSK) lawsuit challenging the deployment of Kenya Defence Forces (KDF) to quell nationwide anti-tax protests.

Justice Lawrence Mugambi on Wednesday directed the LSK to promptly serve the respondents with its petition for a brief hearing scheduled on Thursday.

The LSK had earlier in the day filed a court application to block the government from deploying military officers following a gazette notice issued on Tuesday evening by Defence Cabinet Secretary Aden Duale.

The LSK argued that Kenya had not officially declared any emergency, unrest, or instability that would justify deploying the army to assist the National Police Service personnel

Earlier on Wednesday, MPs approved the deployment of KDF officers nationwide to restore order after anti-tax protests escalated on Tuesday.
