The appellate in a consensus judgment of the three-man-panel read by Justice Usman Musale on Friday, February 10, 2023, consequentially ordered that Sadiq Wali, who was earlier recognised by the Independent National Electoral Commission (INEC), remains the valid gubernatorial candidate of the PDP for Kano state.

The court held that the law is clear that only the National Executive Committee (NEC) of the party can conduct the gubernatorial primary elections of a party and since Abacha did not participate at the primary election conducted by NEC that produced Wali and thus had no locus standi to challenge the said primary.

Recall that a Federal High Court sitting in Kano on December 22, 2022, in a ruling presided over by Justice AM Liman affirmed Mohammad Sani Abacha as the Kano duly elected governorship candidate of the Peoples Democratic Party (PDP).

Justice A.M Liman delivered the judgement virtually nullifying the primary election that produced Sadik Aminu Wali as Kano PDP governorship candidate and ordered the Independent Electoral Commission (INEC) to expunge his name for Muhammad Sani Abacha.
