ONITELE STOOL: Ogun Govt., Ademola Eletu, Olota, Reps Member Afuape and 8 Others Sued Over Document Falsification

The Adogun Atele Royal Family of Itele Awori Kingdom has filed a several allegations against the imposed Onitele of Itele, Mr Ademola Eletu Asorota, Honourable Afolabi Moruf Afuape, Member Federal House of Representatives, Abeokuta South Fed. Constituency, Kabiru Adeyemi Obalanlege, Olota of Otta, Solomon Dada, Official of Ado Odo/Ota Local Government, Lukmon Opaleye, official of Ado Odo Otta Local Government, and other contributing parties at Ogun State High Court in Abeokuta, accusing them of of document falsification, impersonation of Supreme Court judgement debtors and fraudulent process of Installation and appointment of Ademola Eletu Asorota as the Onitele of Itele on July 28th, 2021.

The fresh suit with No. AB/492/2023 which was filed on Thursday July 13th according to court documents was made available to the press amidst the controversial proposed One year coronation anniversary of Mr Ademola Eletu Asorota scheduled to commence on the 28th of July 2023.

In the court document, the charges before the court to determine includes the following;

1.  A request that the falsification of a purported minutes of meeting for Adogun Atele family by the 1st – 6th Defendants’ on the 5th August; 2020 and acted upon by the 7th – 11th Defendants as alluded to by the Governor of Ogun State and Ado Odo Ota Local Government  in their Counter Affidavit filed at the Supreme Court Registry in SC: 200/2003 file on the 4th July, 2022 by the Office of the Attorney General of Ogun State in the appointment of the Ademola Asorota as Onitele of Itele is illegal, null and void.

2. A DECLARATION that the purported appointment of Warrant Kingmakers by the 7th – 10th Defendants’ as alluded to by the 7th & 10th Defendants in Paragraph 11 of their  Counter Affidavit filed at the Supreme Court Registry in SC: 200/2003 on the 4th July, 2022 by the Office of the 9th Defendant pursuant to the purported meeting organized and superintended by the 1st – 6th Defendants in the name of Adogun Atele family on the 5th August, 2020 and acted upon by the 7th – 10th Defendants in the appointment of Ademola Asorota as Onitele of Itele in clear disregard and disrespect of the Supreme Court Judgment in SC: 200/2003 and is therefore illegal, null and void.

3. A DECLARATION that the purported proceedings and decisions taken or reached by the Warrant Kingmakers appointed by the 7th – 10th Defendants’ at their purported meeting held on the 7th August, 2020 as alluded to by the 7th & 10th Defendants in Paragraph 13 of their  Counter Affidavit filed at the Supreme Court Registry in SC: 200/2003 on the 4th July, 2022 by the Office of the 9th Defendant pursuant to the purported meeting organized and superintended by the 1st – 6th Defendants in the name of Adogun Atele family on the 5th August, 2020 and acted upon by the 7th – 10th Defendants in the appointment of Ademola Asorota as Onitele of Itele in clear disregard and disrespect of the Supreme Court Judgment in SC: 200/2003 is illegal, null and void.

4. A DECLARATION that the appointment of Ademola Eletu Asorota as the Onitele of Itele by the purported Warrant Kingmakers appointed by the 7th – 10th Defendants pursuant to the purported meeting organized and superintended by the 1st – 6th Defendants in the name of Adogun Atele family on the 5th August, 2020 and acted upon by the 7th – 10th Defendants’ in the appointment of the 6th Defendant as Onitele of Itele in clear disregard and disrespect of the Supreme Court Judgment in SC: 200/2003 amount to abuse of Office, breach of public trust and public confidence in their respective public offices occupy.

5. A DECLARATION that the ratification of the appointment of the Ademola Asorota by the 7th -9th Defendants’ as representatives of the Executive Council of Ogun State as announced and posted on the Social media by Mr. Kunle Somorin, the Chief Press Secretary of the 7th Defendant on behalf of the Council is illegal, unlawful, null and void 

6. A DECLARATION that the invasion of Itele Kingdom held in trust by the Claimants’ as declared by the Supreme Court in SC: 200/2003 by the Kabiru Adeyemi Obalanlege and Ademola Eletu Asorota’ with the aid of Armed Military men to supervise the demolition of the Claimants’ ongoing Construction of Onitele of Itele Palace by Kabiru Adeyemi Obalanalege’s thugs imported into Itele to cause apprehension is illegal, unlawful, abuse of Power, abuse of traditional privileges, therefore null and void and of no effect

7. A DECLARATION that the military invasion of Itele Kingdom led by the Kabiru Adeyemi Obalanlege, the traditional Head of Ota Kingdom which is distinct and separate from Ota Kingdom is abuse of traditional privilege and sacrilegious conduct unbecoming of a traditional ruler.

8. A DECLARATION that the Kabiru Adeyemi Obalanlege by his conduct of leading Military men into Itele, another Kingdom with the sole aim of suppressing the compliance with the Supreme Court Judgment in SC.200/2003; supervision of the demolition of the construction of another kingdom’s palace and involvement in the falsification of a purported minutes of meeting for Adogun Atele family on the 5th August; 2020 and acted upon by the 7th – 11th Defendants as alluded to by the 7th & 10th Defendants in the Paragraph 10 of their  Counter Affidavit filed at the Supreme Court Registry in SC: 200/2003 file on the 4th July, 2022 by the Office of the 9th Defendant in the appointment of Ademola Asorota as Onitele of Itele is unfit to continue to hold the highly revered stool of a traditional ruler.

9. AN ORDER OF THE HONOURABLE COURT barring the Mr Peter Fagbohun, Hon. Moruf Afolabi Afuape, Mr Solomon Dada, Mr Lukmon Opaleye, Oba Kabiru Adeyemi Obalanlege and Ademola Eletu Asorota from further holding any public Office or entrust them with public trust/public Office for fraudulently organizing and superintending a meeting in the name of Adogun Atele family which purportedly took place  on the 5th August, 2020 as alluded to in the 7th & 10th Defendants Paragraph 10 of their Counter Affidavit filed at the Supreme Court Registry in SC: 200/2003 on the 4th July, 2022 and filed by the Office of the 9th Defendant at the Supreme Court

10. AN ORDER OF THE HONOURABLE COURT declaring the letter of appointment with Reference No. CHM. 2/27T/566 dated the 27th July, 2022 and titled the “APPOINTMENT OF ONITELE OF ITELE IN ADO-ODO/OTA LOCAL GOVERNMENT” and addressed to Ademola Asorota and signed by the 1st Defendant on behalf of the 7th – 10th Defendants pursuant to the fraudulent meeting organized and superintended by the 1st – 6th Defendants in the name of Adogun Atele family which purportedly took place  on the 5th August, 2020 as alluded to in the 7th & 10th Defendants Paragraph 10 of their  Counter Affidavit filed at the Supreme Court in SC: 200/2003 on the 4th July, 2022 by the Office of the 9th Defendant as illegal, null and void and of no legal effect.

11. AN ORDER OF MANDATORY INJUNCTION compelling the 7th – 10th Defendants to commence fresh process for the appointment of Onitele of Itele in line with the four Ruling Houses declared by the Supreme Court in SC: 200/2003-Chief Gafaru Arowolo vs Chief Edun Olowookere delivered on the 16th December; 2011 in which the 7th & 10th Defendants’ were parties.

12.  AN ORDER OF MANDATORY INJUNCTION compelling the 7th – 10th Defendants to withdraw the letter of appointment issued to Kabiru Adeyemi Obalanlege, Olota of Otta as a traditional ruler for his involvement in the military invasion of another kingdom, falsification and manipulation of processes leading to the appointment of the Ademola Eletu Asorota as Onitele of Itele in a clear disregard and disrespect for the Supreme Court Judgment in SC: 200/2003 which had declared the Claimants’ family comprising of Imidawo Ruling House otherwise called Ijagona ruling House; Oosa Ruling House also known as Isunba ruling House; Ogunrombi Ruling House otherwise referred to as Idotele ruling House and Alagbeji Ruling House sometimes called Ipotobo/Ilogun ruling House as contained in the Supreme Court judgment in SC: 200/2003- Chief Gafaru Arowolo v Chief Sunday Edun Olowookere & Ors reported at Page 294 of the Nigerian Weekly Law Report (2011)18NWLR Pt1278 Pg 294 out of which the Ademola Asorota, the purportedly installed Onitele of Itele does not come from any of the ruling Houses or by blood related with Adogun Atele family.

13. AN ORDER OF PERPETUAL INJUNCTION restraining the Ademola Eletu Asorota from further parading himself or holding himself out as Onitele of Itele-Awori, via Ota, Ogun State in the Ado/Odo/Ota Local Government on the ground that he was not validly nominated; screened by Warrant Kingmakers; appointed and installed as the Onitele of Itele in line with the Judgment of the Supreme Court in SC:200/2003 which clearly declared the Claimants’ as the only eligible persons to the stool of Onitele of Itele.

14. AN ORDER OF THE HONOURABLE COURT declaring all the actions performed by the Ademola Asorota as Onitele of Itele-Awori via Ota; Ogun State pursuant to his fraudulent appointment as Onitele of Itele in line with the Adogun Atele family meeting fraudulently organized and superintended and purportedly acted upon by the warrant Kingmakers as alluded to in Paragraph 13 of the 6th & 9th Defendants’ Counter Affidavit filed at the Supreme Court by the Office of the 9th Defendant on the 4th July, 2022 as illegal null and void

16. AN ORDER OF THE HONOURABLE COURT directing the Ademola Asorota to refund all salaries, emolument and allowances paid to him and received as Onitele of Itele Awori, via Ota in the Ado/Odo/Ota Local Government pursuant to the fraudulent process that produced him as the Onitele of Itele Kingdom.

17. AN ORDER OF MANDATORY INJUNCTION compelling the 1st – 10th Defendants to reconstruct a befitting Palace of Onitele of Itele, a First Class Monarch and Permanent member of the 11th Defendant which the Claimants’ Palace under construction was demolished on the authority and supervision of the 1st – 6th Defendants who acted as officers and agents of the 7th – 10th Defendants

18. AN ORDER PERPETUAL INJUNCTION restraining Egba Traditional Council under the headship of Alake of Egba Land from further allowing the Ademola Asorota from further attending and participating in the meeting of the Council on the basis that he was not legally nominated and appointed as Onitele of Itele in line with the Supreme Court Judgment in SC: 200/2003- Arowolo vs Olowookere delivered on the 16th December; 2011

19. The Sum of N5 Million Naira as general and special damages jointly and severally against the 1st – 10th Defendants’ for the trauma caused the Claimants’ family for the illegality perpetrated by the 1st – 6th Defendants’ as agents and representatives of the 7th – 10th Defendant.
